Acceptable use
Join us in promoting the positive use of the Internet...
The Internet is a voluntary association of users interested in and willing to exchange information and data with other Internet users. At present there is no oversight group providing governance over the principles, policies or procedures for use of the Internet or the information and data accessed via the Internet. In order to facilitate their contractual relationship the Customer and web-hosting-buddy wish to define a working protocol of principles and policies and establish operating guidelines and acceptable standards of use of the Internet. To this end the parties agree as follows:

1) Knowledge of the Internet
The Customer agrees to obtain a basic knowledge of the Internet and its operating principles and procedures. The Internet is a network intended for use by mature, adult users. The Customer recognises this principle and undertakes at all times to act with respect, courtesy and responsibility, giving due regard to the interests and rights of other Internet user groups

2) Improper Uses
Web-hosting-buddy's Internet Services may only be used for lawful purposes. Transmission of any material in violation of any national, federal or state statute or regulation is prohibited. This includes, but is not limited to material legally judged to be threatening or obscene, compromise of copyrights, trade secrets, proprietary information and other intellectual property rights, libel or defamation of character, invasion of privacy, tortuous interference, and export of technical or military data to prohibited countries. The posting of copyrighted software without proper authorisation (commonly referred to as Warez) and/or the posting of software access codes (commonly referred to as Cracks) will be cause for account cancellation with forfeiture of prepaid fees. You agree to indemnify and hold harmless web-hosting-buddy from any claims resulting from your use of web-hosting-buddy's service. In addition the Customer will avoid violation of certain generally accepted guidelines on Internet usage such as mass mailings, mass advertisements, pirating or copying of software, mail bombing or other methods of attempting to deny service or access to other users, and attempts to violate security.

3) Pornography
Due to legal and social issues, we will not accept any new customers who publish pornographic images. We do not allow any pornographic content on our server, including but not limited to nude photographs, explicit language, or sexual fiction. If an existing customer publishes pornographic images, web-hosting-buddy may suspend and/or cancel your account. Let's make this easy to understand:

No site that promotes porn or nudity will be allowed on our servers, this includes BANNERS, CLICKER SITES, EDITORIALS, STORIES, NUDE PHOTOGRAPHS, EXPLICIT LANGUAGE, SEXUAL FICTION, OR ANYTHING THAT SMALL GREEN TREE DEEMS INAPPROPRIATE FOR OUR SERVERS. If an existing customer publishes pornographic images, web-hosting-buddy will remove your site from our server and all monies paid will be forfeited.

In addition the Customer is expected to use discretion in the treatment and handling of Internet information and data and to take particular care to insure that adult information is not transmitted to juvenile users of the Internet

4) Excessive CPU usage
Customers will not be allowed to use unusual and excessive amounts of CPU processing on any of our servers or face immediate suspension. For example:

a) A few customers have tried reselling our counters or auto-responders to the rest of the world which caused an excessive amount of requests on our server(s).
b) E-mail bombs.
c) Sites with banners, graphics or CGI scripts running on their own domain but actually used on other domains.
d) Reselling CGI access to other 3rd parties
e) Chat rooms, either Java or CGI are prohibited; we suggest using our new Java Chat service instead.
f) IRC Daemons, are strictly prohibited
g) Sites with picture galleries (This is any site where 50% of the files transferred are graphics)
h) Sites offering download files or archives. (This is any site where 50% or more of their monthly traffic is from file downloads)
i) Sites using more than 30% of system resources

The intention of web-hosting-buddy is to provide a large space to serve web documents, not an off site storage area for electronic files. All (90%) of your web pages (HTML) must be 'linked' with files (.GIF, .JPEG, etc.) stored on web-hosting-buddy's server. Web sites that are found to contain either/or no HTML documents, a large number of unlinked files are subject to warning, suspension or cancellation at the discretion of web-hosting-buddy management.

5) Bulk E-mail, Spam, or Unsolicited E-mail Submission
NO DOMAIN MAINTAINED BY web-hosting-buddy will be permitted to submit BULK E-MAIL of any type. This includes but not limited to using our E-mail server or any other BULK E-MAIL submission service, i.e. Cyber Promotions. This includes but is not limited to the the use of the Domain Name or an E-mail Address for the Domain Name in the actual Bulk Emily. If we receive a complaint on a BULK E-MAIL from a Domain maintained on our servers, the account will be subject to suspension and/or cancellation without notice. In addition the promotion or sale of bulk e-mail software or procedures is prohibited

Commercial advertising is an accepted and welcome use of the Internet. However, there are appropriate and inappropriate places for Internet advertising. Unsolicited commercial advertisements are not allowed in e-mail, and will result in account suspension or cancellation. Commercial advertisements are unwelcome in most Usenet discussion groups and on most e-mail mailing lists. Inappropriate posting may result in account suspension or cancellation. See the newsgroup or mailing list's charter for whether advertising is allowed or not. "Spamming," or sending a message to many different off-topic newsgroups, is particularly unacceptable and will be treated as such. Sending a message, especially an advertisement, to more than five or six recipients, is by itself spamming unless the individuals have specifically requested to be added to a mailing list on that topic. E-mail is a person-to-person medium, not a broadcast medium.

By the use of our Domain Maintenance Services, Uploading your files to our server(s) and/or the use of our E-mail services you hereby agree to the terms of our "Accepted Usage Policy" as well as the policies set forth on our Terms and Conditions page.

The policies and guidelines expressed herein supplement the rights and obligations of the parties under the agreement to the Terms and Conditions of even date. This document establishes operating principles and acceptable use policies as they relate to the Customer's use of the Internet and the connection/services provided by web-hosting-buddy to the Customer under the agreement.
